GENERAL TERMS AND CONDITIONS OF USE

Lega Calcio Serie A, with registered office at Via Rosellini 4, Milan, Italy, certified email address (PEC) direzioneseriea@legalmail.it, email address direzione@legaseriea.it and telephone number +39 02 699101, welcomes you to its official information platforms, including its website, applications and Single Sign-On systems.

In order to enable users to use the aforementioned platforms and access all services and tools contained therein, each hereinafter referred to as a “Tool” and collectively as the “Tools”, you are requested to read carefully and accept the general terms and conditions of use set out below, hereinafter the “General Terms and Conditions of Use”.

By using the Tools, you fully accept these General Terms and Conditions of Use. Lega Calcio Serie A offers a broad range of services, and additional terms and conditions may apply to certain services.

Where use of the Tools requires registration, the user, hereinafter the “User”, will be required to declare that they are at least 18 years of age and that they have read the General Terms and Conditions of Use, by providing electronic acceptance and clicking the “I Accept” link or a similar button.

Upon accepting the General Terms and Conditions of Use, the User must read the privacy notice concerning the processing of personal data pursuant to Regulation (EU) 2016/679, the GDPR, and provide consent to the processing of their personal data where required.

1. REGISTRATION

1.1 Access to the Tools is free of charge. The Tools are managed by Lega Calcio Serie A and, where registration is required, are intended for Users who are at least 18 years of age. Before registration, Lega Calcio Serie A asks each User to read carefully and accept these General Terms and Conditions of Use and the privacy notice concerning personal data collected through the Tools.

1.2 Upon completing the registration and enrolment procedure by entering a username, namely an email address, and password, hereinafter the “Credentials”, the User is asked to click the “I Accept” link or a similar button. By doing so, the User declares that they have carefully read and expressly accepted all conditions, terms and methods governing the use and enjoyment of the Tools, and that they are aware of all their features and purposes. The User is requested to print a copy of the General Terms and Conditions of Use or save them on a durable medium.

1.3 The Credentials are personal and may not be used by third parties to access the Tools.

1.4 The User undertakes to keep their Credentials confidential and not to allow third parties to use them.

1.5 The User undertakes not to register more than once and not to create additional accounts for the purpose of misusing the functions of the Tools.

1.6 The User undertakes to: (a) provide truthful, accurate, up-to-date and complete data and information upon registration; and (b) maintain and update the registration data through their restricted area so that such data remain truthful, accurate, up-to-date and complete. The User is solely responsible for providing incorrect or false information and data, or information and data relating to third parties without their consent, and for any improper use thereof.

1.7 The User is solely and exclusively responsible for the safekeeping, confidentiality and use of their Credentials and, accordingly, remains solely and exclusively responsible for any proper or improper use thereof.

1.8 As soon as the User becomes aware of, or suspects, any compromise of their Credentials, the User undertakes to notify Lega Calcio Serie A immediately by email at customer.support@legaseriea.it, attaching a copy of a valid identity document. Following the report, Lega Calcio Serie A will deactivate the User’s registration. Failure to report the compromise, followed by the disabling of the registration, shall result in the User’s direct and exclusive liability for all uses connected with their Credentials.

1.9 The User may cancel their registration and therefore their data at any time through the dedicated function available in their restricted area. If the User is unable to access their restricted area, the cancellation request may be sent to Lega Calcio Serie A by email at customer.support@legaseriea.it, attaching a copy of a valid identity document. Permanent closure of the account will be immediate where carried out directly by the User through their restricted area, whereas a request submitted by email will be processed within one working day of receipt.

1.10 Lega Calcio Serie A shall not be liable to the User or any third party for any modification, suspension, interruption or discontinuation of the Tools.

1.11 Lega Calcio Serie A reserves the right to accept a registration request submitted by the User and will confirm acceptance to the applicant by email or by any other method communicated to the User.

2. DESCRIPTION OF THE SERVICES

2.1 Lega Calcio Serie A enables each User to benefit from the services available through the Tools, including, by way of example, news, photographs, videos, results, standings and statistics, as well as interactive services such as games, quizzes and surveys, in accordance with the terms and conditions established for each Tool.

2.2 Users acknowledge that all costs relating to the equipment and software required to activate and establish a connection with the Tools and, consequently, to use the Tools, as well as all network connection costs, shall be borne exclusively by the Users.

2.3 Under no circumstances shall Lega Calcio Serie A be held liable where the User is unable to access and/or use the Tools due to the failure and/or defective operation of the equipment, software or network referred to in Article 2.2 above, or for any other cause not attributable to Lega Calcio Serie A. Furthermore, Lega Calcio Serie A shall under no circumstances be held liable for the User’s failure to perform, or incorrect performance of, any procedures required by law or regulation.

2.4 The Tools may be used exclusively for personal and non-commercial purposes.

2.7 Lega Calcio Serie A reserves the right to modify or suspend access to the Tools, temporarily or permanently and in whole or in part, without incurring any liability and without any requirement to provide prior notice or communication.

3. DISCLAIMER OF WARRANTIES BY LEGA CALCIO SERIE A

3.1 Lega Calcio Serie A gives no warranty that the Tools will meet the User’s requirements and/or expectations.

3.2 Lega Calcio Serie A gives no warranty regarding the results that may be obtained through use of the Tools or the truthfulness and/or reliability of any information, data or news obtained by the User through the Tools.

4. PERSONAL DATA

4.1 Lega Calcio Serie A will process all personal data provided by Users upon registration and/or acquired as a result of their use of the Tools in full compliance with Regulation (EU) 2016/679, in accordance with the methods and for the purposes described in the privacy notice made available to the User at https://en.legaseriea.it/privacy-policy, which forms an integral part of these General Terms and Conditions of Use.

5. COPYRIGHT AND DATABASE RIGHTS

5.1 All content included in or made available through the Tools, including text, graphics, logos, icon buttons, images, audio files, video files, digital downloads, data compilations and software, is owned by Lega Calcio Serie A, its partners or its content suppliers and is protected by applicable international intellectual property laws.

5.2 It is prohibited to extract and/or use, in whole or in part, content made available through the Tools without the express written consent of Lega Calcio Serie A. By way of example, the use of data mining, robots or similar data-gathering or extraction tools is prohibited.

6. TRADE MARKS

6.1 The graphics, logos, page headers, icon buttons, scripts and service marks included in or made available through the Tools are trade marks or distinctive signs of Lega Calcio Serie A and may not be used in connection with any products or services that are not those of Lega Calcio Serie A, in any manner likely to cause confusion, or in any manner that disparages or discredits Lega Calcio Serie A. All other trade marks displayed through the Tools are the property of their respective owners.

7. PATENTS

7.1 The Tools and their related functions are protected by patents and licences owned by Lega Calcio Serie A and/or third parties.

8. THIRD-PARTY ACTIVITIES

8.1 Lega Calcio Serie A may allow third parties to provide services through the Tools. The detail pages relating to each Tool will indicate whether the relevant Tool is provided by a third party.

8.2 Where parties other than Lega Calcio Serie A provide functions within the Tools, Lega Calcio Serie A shall not be responsible for monitoring and/or assessing such parties, their actions or the tools they provide, nor shall it provide any warranty regarding their offerings or services. In such cases, the User must carefully review the privacy notices and other terms of use provided by those parties.

9. LIMITATION OF LEGA CALCIO SERIE A’S LIABILITY

9.1 The User acknowledges and agrees that Lega Calcio Serie A shall under no circumstances be liable for any direct or indirect damage suffered by the User or any third party arising from:

1. the use of, or inability to use, the Tools;
2. the modification, suspension or interruption of services provided through the Tools;
3. messages received from or through Lega Calcio Serie A;
4. unauthorised access to or alteration of the User’s transmissions and/or data, including, without limitation, any loss, including financial loss, suffered by the User as a result of loss of profit, use, data or other intangible assets.

9.2 Without prejudice to any other provision of these General Terms and Conditions of Use, the User expressly acknowledges and declares that:

1. use of the Tools is entirely at the User’s own risk and the Tools are provided by Lega Calcio Serie A on the basis that the User assumes sole and full responsibility;
2. Lega Calcio Serie A disclaims all liability and warranties, whether express or implied, including any warranty as to the continuity, quality or quantity of the services provided through the Tools;
3. the User shall bear sole responsibility for any damage to computer systems or loss of data resulting from uploading and/or downloading material relating to the Tools;
4. Lega Calcio Serie A accepts no liability for any damage, loss of data or information, loss caused by delay or loss of opportunity, inaccurate or unsuccessful retrieval of information, restrictions on or loss of access, difficulties or problems of any kind, or errors occurring while accessing the services and/or Tools;
5. Lega Calcio Serie A, its suppliers and its partners shall not be liable for the failure of any software, authorisation system, data-processing system, communication or transmission system, or any other system that is not under their control;
6. Lega Calcio Serie A, its suppliers and its partners shall not be liable for any damage or malware that alters or damages Users’ devices as a result of accessing the Tools.

9.3 Except as otherwise provided in these General Terms and Conditions of Use, all warranties provided by law in favour of the User are excluded to the fullest extent permitted by applicable law.

10. SUPPORT AND COMPLAINTS

10.1 Lega Calcio Serie A undertakes to provide User support through the technical support and assistance email address customer.support@legaseriea.it. Details of the services are available through the relevant Tools. In the event of any conflict between information provided through the Tools and/or the support email address and these General Terms and Conditions of Use, these General Terms and Conditions of Use shall prevail.

10.2 Any complaint received through the support email address will be reviewed in order to assess any support measures for the User or improvements to the services. All complaints submitted by Users are recorded and stored in a dedicated information system that ensures their traceability.

11. AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS OF USE

11.1 Lega Calcio Serie A reserves the right to amend these General Terms and Conditions of Use at any time, at its sole discretion and without prior notice. Continued use of the Tools following such amendments constitutes the User’s unconditional acceptance thereof. Any amendment to these General Terms and Conditions of Use shall become effective as soon as it is published through the Tools.

12. ASSIGNMENT OF THE AGREEMENT

12.1 Provided that the protection of the User’s rights is not reduced, Lega Calcio Serie A may assign this Agreement to third parties without requiring any further acceptance by the User, such acceptance being hereby given and confirmed in advance.

12.2 The User may not assign this Agreement and/or any rights and/or obligations arising from it to third parties without the prior written authorisation of Lega Calcio Serie A.

13. GOVERNING LAW AND JURISDICTION

13.1 This Agreement is governed by Italian law.

13.2 The courts of Milan shall have exclusive jurisdiction over all disputes relating to the performance or interpretation of these General Terms and Conditions of Use, except for disputes involving a User who qualifies as a consumer, which shall fall within the jurisdiction of the courts for the place where that User resides or is domiciled, provided that such place is in Italy.

14. MISCELLANEOUS

14.1 Any tolerance shown in practice by Lega Calcio Serie A in relation to a breach of any provision of these General Terms and Conditions of Use shall not constitute a waiver of, or derogation from, the relevant written provision, which Lega Calcio Serie A may enforce at any time.

14.2 If one or more provisions of these General Terms and Conditions of Use are found to be invalid or ineffective, such invalidity or ineffectiveness shall not extend to the remaining provisions. Any invalid or ineffective provision shall be replaced by a valid and effective provision that achieves, to the greatest extent possible, the intended effect of the provision found to be invalid or ineffective.

To enter into this Agreement, the User must click the “I Accept” link or a similar button.

By completing the registration process, you declare that you are at least 18 years of age, that you have read the privacy notice prepared pursuant to Regulation (EU) 2016/679, and that you accept the above General Terms and Conditions of Use governing registration for the Serie A Tools and use of the services offered through them. You also specifically accept, pursuant to Articles 1341 and 1342 of the Italian Civil Code, Articles 1, 3, 9, 11, 12 and 13 of these General Terms and Conditions of Use.

SPECIFIC APPROVAL PURSUANT TO ARTICLES 1341 AND 1342 OF THE ITALIAN CIVIL CODE

To enter into this Agreement, the User must also click the “I Accept” link or a similar button as evidence of acceptance and express approval, including pursuant to Articles 1341 and 1342 of the Italian Civil Code, of the provisions contained in Article 1 (“Registration and Acceptance of the General Terms and Conditions of Use”), Article 3 (“Disclaimer of Warranties by Lega Serie A”), Article 9 (“Limitation of Lega Serie A’s Liability”), Article 12 (“Assignment of the Agreement”), Article 11 (“Amendments to the General Terms and Conditions of Use”) and Article 13 (“Governing Law and Jurisdiction”).
